For decades, administrative law provided a relatively stable institutional framework within which administrations of both parties used executive action to pursue their policy priorities. Yet in just the last several years, that stability has been shaken, even disrupted entirely. Administrative law is entering a new era due to both presidential actions and the decisions of the Supreme Court. This new era—characterized by a retreat from the “regular order” that had prevailed for decades—raises pressing questions about how government will operate and what legal principles will constrain agencies, presidents, and courts in the years to come.

Leading scholars and practitioners will discuss the implications of a suite of recent Supreme Court decisions on administrative law as well as actions of the current administration in Washington, D.C., taking up issues such as agency autonomy in the wake of Trump v. Slaughter, rebuilding trust in the administrative state, and the future of administrative agencies, administrative procedure, and judicial review.

The Law Review is proud to partner with Professors Cary Coglianese and Kate Shaw from the University of Pennsylvania and collaborate with the Penn Program on Regulation to present this Symposium.
